Terms and Conditions of Sale & Service

These Terms and Conditions govern your use of the Summer Salt Cornwall website (the "Website") and your purchase of goods and services from us, including but not limited to furniture, artisan crafts, surfboard shaping services, clothing, and food/beverages from our coffee shop.

By placing an order or using our services, you agree to be bound by these Terms and Conditions.

1. General Information

1.1 Definitions

  • "Summer Salt Cornwall," "we," "us," or "our" refers to Summer Salt Cornwall

  • "Customer," "you," or "your" refers to the person or entity purchasing goods or services from us.

  • "Goods" refers to all physical items sold by us, including furniture, crafts, and clothing.

  • "Bespoke Goods" refers specifically to custom wood/resin furniture and custom-shaped surfboards.

  • "Services" refers to the provision of coffee shop items (food/drink) and any non-physical services offered.

2. Ordering, Pricing, and Payment

2.1 Order Acceptance

All orders placed by you are subject to acceptance by us. We reserve the right to refuse any order. Order acceptance is confirmed when we send you an email confirmation stating the order has been processed or, in the case of Bespoke Goods, when the initial design deposit is received.

2.2 Pricing and Availability

  • All prices are quoted in GBP and include VAT where applicable (unless otherwise stated).

  • Prices for Goods and Services are subject to change without notice, but changes will not affect orders that have already been confirmed.

2.3 Payment Terms

  • Payment for standard Goods and Clothing is required in full at the time of placing the order.

  • For Bespoke Goods (Furniture & Surfboards):

    • A non-refundable design or commencement deposit of  50% of the estimated total price is required before work begins.

    • The remaining balance is due upon completion and prior to delivery or collection. We will provide photographic confirmation of completion.

3. Product-Specific Terms

3.1 Wood/Resin Furniture and Artisan Driftwood Crafts

  • Natural Variation: Due to the nature of wood, resin, and driftwood, every item is unique. Wood grains, colour, knots, and the appearance of resin flow will vary. Photographic representations are indicative; the final product may differ slightly.

  • Defects/Wear: Small imperfections, splitting, and natural wear in driftwood or repurposed timber are inherent characteristics of the artisan nature of the Goods and are not considered defects unless they compromise the structural integrity.

3.2 Bespoke Surfboards and Furniture (Custom Orders)

  • Specification: The Customer is responsible for ensuring the accuracy of all specifications provided for Bespoke Goods (e.g., surfboard dimensions, furniture sizes, colour choices). Once the design deposit is paid, changes to the specification may incur additional charges and may extend the lead time.

  • Cancellation (Bespoke): The initial deposit for Bespoke Goods is non-refundable as it covers the costs associated with design, material sourcing, and commencement of manufacturing.

3.3 Clothing and Retail Goods

  • Stock: We aim to keep all listings up to date, but if an item of clothing is out of stock after your order is placed, we will notify you immediately and offer a full refund or an alternative product.

4. Delivery, Title, and Risk

4.1 Delivery Estimates

  • Standard Goods: Delivery times are estimates only. We are not liable for any delays caused by third-party delivery services.

  • Bespoke Goods: Lead times for custom orders will be provided at the time of quotation and are estimates only. Time is not of the essence in the performance of any services.

4.2 Risk and Title

  • Risk of damage to or loss of the Goods shall pass to you upon delivery or collection.

  • Title to the Goods shall not pass to you until we have received full payment for the Goods and all other amounts owed by you to us.

4.3 Inspection on Delivery

You must inspect the Goods immediately upon delivery. If Goods arrive damaged or defective, you must notify us within 48 hours of receipt, providing photographic evidence of the damage to both the packaging and the Goods. Failure to notify us within this timeframe may affect your claim.

5. Returns and Cancellation

5.1 Standard Goods (Furniture, Crafts, Clothing)

You have the right to cancel your purchase of standard Goods within 14 days without giving any reason, in line with UK consumer rights law.

  • The cancellation period expires 14 days after the day you receive the Goods.

  • Goods must be returned in their original, unused, and resalable condition.

  • You are responsible for the cost of returning the Goods.

5.2 Exclusions (Non-Returnable Items)

The right to cancel does not apply to:

  • Bespoke Goods: Goods made to your specification or clearly personalised (e.g., custom furniture, custom surfboards).

  • Perishable Goods: Food and beverages purchased from our coffee shop.

6. Coffee Shop and On-Premises Services

6.1 Allergens and Dietary Requirements

  • While we take all reasonable care, our coffee shop environment handles various ingredients, and we cannot guarantee that any item is 100% free of allergens.

  • You must inform our staff of any allergies or dietary requirements when ordering. We are not liable for allergic reactions resulting from failure to disclose this information.

6.2 On-Premises Conduct

We reserve the right to refuse service to any customer displaying inappropriate, offensive, or unsafe behaviour on our premises.

7. Limitation of Liability and Warranty

7.1 Warranty

We warrant that the Goods will be free from material defects in material and workmanship for a period of 6 months from the date of delivery. This warranty does not cover:

  • Normal wear and tear.

  • Damage caused by misuse, poor maintenance, or neglect.

  • Natural changes in wood/resin, such as movement, cracking, or colour change due to environmental conditions (heat, humidity).

7.2 Liability

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Subject to the foregoing, our total liability to you in respect of all losses arising under or in connection with any contract shall in no circumstances exceed the price of the Goods or Services.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

9. Changes to the Terms

We reserve the right to amend these Terms and Conditions at any time. The date of the last update will be clearly marked at the top of this policy.
